Personal data – any info about a person that can identify him/her – identification data, address, any description, not just the names and numbers
Data processing – any ongoing operation or system with personal data, primarily gathering, saving on the hard discs, accessibility, changes, searching, use, transfer, sharing, separation and liquidation
Agent – all employees and interns, the owner Zuzana Žatečková under the business name Nový start
Personal data administrator – agent and all of his/her employees (consultants) processing personal data who is potentially choosing another people processing the data
Processor – any person processing data authorized by the administrator such as the IT contractors, accountant, marketing people (MailChimp – collective e-mail and newsletters)
Sensitive data – data showing nationality, race or ethnicity, political views, religion or philosophy, conviction, health condition and sexual preferences or any genetical or biological data enabling direct identification or authentication of the subject. Management of photos and video recordings is not sensitive data processing. SSN is not the sensitive data.
Applicant / Candidate – a person being contacted by the agent for the purpose of job search
Client – companies /employers using a service of mediation of suitable candidates for their job openings. Collaboration is under the contract with terms of privacy in regard to other subjects
Personal data of candidates specified below will be processed for purpose of:
a) Selection of a suitable candidate
Personal data processing is needed during selection of a suitable candidate for client and making a following contract. This purpose is filled with the end of the recruitment process with the candidate.
b) Posibility of a future contact in regard of a new job opening (after the particular interviewing process was finished) – consent for this specific purpose (8)
Personal data of a candidate can be, with the candidate’s consent, processed for further offers of new job openings in the future. Data will be stored till the end of the 3rd calendar year after the end of recruitment (for instance data from interviews finished in 2018 will be disposed (deletion, destruction) in the end of 2021
The extent of personal data strictly corresponds with the purpose of processing. An agent will process personal data stated in the candidate’s resume or in other of his/her documents (education documents, certifications, cover letters, etc) or also data presented in person during the interview, etc. All data is related to the previous professional experiences of a candidate, his/her skills and qualification, requirements for potentional new job position with future employer or agent itself.
Personal data of candidates is obtained directly from the candidate, from the database of job servers ( for example LMC s.r.o. owner of www.jobs.cz, www.prace.cz, also many others), through the agent ( for example evaluation of candidates by the consultants in a personal interview), from professional social networks (such as LinkedIn) or from other recruitment agencies that an agent collaborates with within the region (such as Hilljobs – Denisa Obrtelová).
Obtained candidate’s info is with his/her previous consent transferred to clients in form of an actual resume and other documents including evaluation of a client by an agent (with the additional info such as required salary, motivation of a candidate, dates of start, client’s personality and attitude influencing an offered job position or an employer, etc.). That includes necessary data transfer to the agent’s collaborants and consultants (external accountant, lawyers, auditors, banks officers, IT workers) if there is a legitimate reason for such.
Candidate has the right for accessing his/her data, its correction or deletion, limiting its use as well as transferability of personal data set by GDPR. Detailed conditions are tied with the law regulation (article 15 and 21 of GDPR). The candidate can object to the use of his/her personal data. They can contact the agent by e-mail. They also has the right to object to the use of their data to the Office for protection of personal data regulation.
Providing candidate’s data for purpose of selection of a suitable candidate is according to the 2.a) above not required but it is necessary for legitimate evaluation of candidate’s chances in a hiring process. Candidate is being aware of processing his/her personal data for this purpose.
Data transfer for the purpose of a future contact in regard of a new job opening according 2.b) above is not required. Consent of the candidate is needed. Agent then contacts a candidates in database with a suitable job positions and sends out regular newsletters with new positions and other news in the blog (once a week).
The candidate has the right to withdrawing his/her consent. Withdrawing of the consent applies to the time of the withdrawing and later, previous data processing with the given consent is legal.
